MiND is the national contact point for punishable, discriminatory statements on the internet. The Netherlands generally has a sound moderation policy. Nonetheless, discriminatory expressions appear that are harmful to groups within our society. Citizens can report this via the digital reporting form on the website. Working method: After receiving a report about a discriminatory statement, MiND first examines whether the statement is (still) online. MiND then assesses whether the utterance is punishable on the basis of article 137c up to and including 137e of the Criminal Code and the related case law. If this appears to be the case, MiND requests the administrator or moderator of the website in question to remove the statement. If a (repeated) request is not complied with, MiND will prepare a declaration file for the Public Prosecution Service (OM). The OM can start a criminal investigation following a declaration.
